LABOUR: Call For Extended Law Review

THE Cape Chamber of Commerce has appealed for more time to consider the far-reaching implications of major changes to three laws governing labour matters and skills development.

The proposed amendments were published on April 15 together with a call for comment within 21 calendar days.

The problem,” said Mr Michael Bagraim, President of the Chamber, “is that there are only 11 working days in this 21-day period and many people have booked leave to take advantage of the public holidays.

In these circumstances it is difficult to get the right people together to assess the implications of the changes and how they will affect business and training programmes already in operation.”

He said the Minister of Higher Education and Training, Dr Blade Nzimande, could not have chosen a worse time for a consultation process. “I’m afraid we must ask why this particular period was chosen. It is certainly not in the interest of good and effective consultation and it leaves us with the feeling that Dr Nzimande does not really want our views.”

The legislation appears to have a major impact on the SETA’S and this will affect training programmes and commitments commerce and industry have already made. We need time to look at the implications and perhaps the unintended consequences. The SEATA’S took years to establish and now we have this sudden rush to change the ground rules. What is going on?”

Mr Bagraim said business needed a few months to make a thorough study of the proposed legislation, consult experts and prepare a proper response to what appeared to be radical changes to labour and training matters.
